Terms of Service

1. Who you are contracting with

This service is provided by Das System(referred to as "Das System", "we", "us" or "our"). When you create an account or use the service, you are contracting with Das System.

2. What the service is

Das System is a web-based point of sale (POS), inventory, accounting and business management platform for retail and wholesale businesses. Access is sold as a one-time lifetime licence for one business. Features may change and improve over time, and future updates are included in the licence.

3. Acceptance of these terms

By creating an account, purchasing a licence or using the service, you agree to these Terms of Service. If you do not agree, do not use the service.

4. Accounts and credentials

You are responsible for keeping your sign-in credentials confidential and for all activity that happens under your account. You must provide accurate business information and keep it up to date. Tell us immediately if you believe someone else is using your account without permission.

5. Payment

Access to the service is granted by a one-time lifetime licence payment of the price shown at checkout. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. 6. Acceptable use

You must not misuse the service. In particular, you must not:

• use it for unlawful purposes, fraud or spam;
• infringe the intellectual property rights of others;
• interfere with the security of the service, attempt to gain unauthorized access, upload malware, probe or scrape the service;
• resell or redistribute access to the service without permission.

7. Intellectual property

The service, including its software, documentation, design and branding, is owned by Das System. We grant you a limited, non-exclusive, non-transferable licence to use the service for your own business under your plan. You may not reverse engineer the service or circumvent its technical limits. Data you enter (products, sales, customers and reports) remains yours.

8. Service availability

We work hard to keep the service running, but we do not guarantee that the service will be uninterrupted or error-free. Scheduled or unscheduled maintenance may temporarily interrupt availability.

9. Suspension and termination

We may suspend or end your access to the service if you materially breach these terms, fail to pay what is owed, create a security or fraud risk, or seriously or repeatedly violate our policies. If your access ends, your business data may be exported to you on request during a reasonable window, after which it may be deleted.

10. Disclaimers and liability

The service is provided "as is". To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. To the extent permitted by law, our total liability to you is limited to the fees you paid in the 12 months before the claim, and we are not liable for indirect, consequential or special damages, including lost profits, data or goodwill. Nothing in these terms limits liability for fraud, or for death or personal injury caused by negligence, where the law does not allow such a limit.

11. Your responsibility for claims

You agree to cover us for claims arising from content you enter into the service, your unlawful use of the service, or your violation of these terms.

12. Governing law and disputes

These terms are governed by the laws of the Republic of Somalia. Disputes will be resolved in the courts of that jurisdiction, unless the law gives you a different mandatory right.

13. Changes to these terms

We may update these terms from time to time. Material changes will be shown in the app or sent to your account email. Continued use of the service after a change means you accept the updated terms.
